General terms and conditions

Any booking of a lake excursion, nautical service, or boat rental made with OffAxis Sàrl implies full and unreserved acceptance of these terms and conditions by the client and their guests. These terms and conditions form an integral part of the contract, whether written or verbal. They are available on the company's website and, where applicable, on board the boats. OffAxis Sàrl's business is now primarily focused on lake excursions and services with a skipper. Rentals without a skipper are offered only in exceptional circumstances, subject to pre-established conditions and express acceptance by OffAxis Sàrl. Every passenger boarding a boat operated by OffAxis Sàrl must read these terms and conditions and agrees to abide by them. For safety reasons, the decisions of the skipper and the OffAxis Sàrl representative are final.

1. Services with a Pilot: The services offered by OffAxis Sàrl are generally provided with a pilot. The pilot remains solely in charge and decides, in particular, the route, speed, maneuvers, authorized activities, stops, the actual number of participants on board, and, more generally, any measure necessary for the safety of persons, the boat, and the equipment. OffAxis Sàrl reserves the right to refuse boarding or to interrupt a service in the event of dangerous behavior, intoxication, drug use, failure to comply with safety instructions, adverse weather conditions, overloading, or any other circumstance likely to compromise the safety or smooth running of the outing. In such a case, no refund will be due when the interruption or refusal of boarding results from the behavior of the client or their guests. Persons sailing or staying on board, particularly those practicing water sports and lake activities, do so under their sole and entire responsibility, subject to the mandatory legal obligations of OffAxis Sàrl. Minors sail under the responsibility of their legal guardians or accompanying adults.
2. Reservations and Payment: A minimum deposit of 20% may be required upon booking, unless otherwise agreed. The balance is due no later than the day of service or rental. The reservation is considered valid upon receipt of the deposit by the lessor.
3. Client and Passenger Responsibility: The client and their guests agree to follow the instructions given by the captain or OffAxis Sàrl, to behave prudently and respectfully, and to use the equipment provided with care. Any damage caused by the client or their guests to the boat, equipment, or third parties will be charged to them, unless covered by insurance. The client remains responsible for their personal belongings and valuables carried on board. OffAxis Sàrl accepts no liability for the loss, theft, or damage of such belongings, subject to any overriding mandatory legal provisions. SMOKING CIGARETTES AND CIGARETTES IS STRICTLY PROHIBITED ON BOATS. E-cigarettes and vapes are permitted, unless otherwise instructed by the captain or OffAxis Sàrl.
4. Cancellations: If cancelled more than one week before the service or rental, the entire deposit will be refunded. If cancelled more than 24 hours before the service or rental, the deposit or 20% of the total amount remains payable by the client. If cancelled within 24 hours of the service or rental, 50% of the total amount remains payable by the client. If cancelled on the day of the service or rental, 100% of the total amount is due from the client.
5. Weather conditions In the event of adverse weather conditions making navigation impractical or inappropriate, and at the decision of OffAxis Sàrl or the pilot, the client may choose between: – postponing the reservation to a later date, or – a full refund without charge of the amount paid.
6. Packages: The packages offered by OffAxis Sàrl are seasonal. Full payment must be made before the first outing. Unless otherwise specified, these packages are valid only between April 1st and October 31st of each year. Unused days, hours, or services are neither refunded nor carried over to the following year.
7. Exceptionally: Boat rental without a skipper, subject to pre-established conditions. Boat rental without a skipper is only possible in exceptional circumstances, subject to the express prior agreement of OffAxis Sàrl and compliance with the conditions pre-established by OffAxis Sàrl. OffAxis Sàrl reserves the right to refuse such a rental without having to justify its decision. In the case of a boat rental without a skipper, the renter must, in particular, provide proof of a valid license, sufficient experience, the ability to safely maneuver the boat, and compliance with any additional requirements set by OffAxis Sàrl. For the first boat rental without a skipper, OffAxis Sàrl reserves the right to require a half-hour test and familiarization session, charged at CHF 100.–. The boat is delivered to the renter in perfect working order, clean, and with a full fuel tank. The renter agrees to use the boat with the utmost care and to return it in the same condition: clean, in perfect working order, and with a full tank of fuel. It is strictly forbidden to transport the boat on a trailer or to carry out any repairs without the prior consent of OffAxis Sàrl. For rentals without a skipper, a security deposit of CHF 2,000 is required before departure. This deposit is refunded upon return of the boat, provided it is returned in good condition, clean, with a full tank of fuel, and undamaged. If cleaning is required after the rental, a fee of CHF 150 per hour will be charged. Missing fuel will be charged at CHF 3.50 per liter. Any delay in returning the boat will be charged CHF 100 per 15 minutes. These amounts may be deducted from the security deposit. Any damage caused by the renter or their guests to the rented boats will be the responsibility of the renter, who will be required to reimburse the cost of replacement if insurance does not cover such damage. Persons sailing or staying on board, particularly those participating in water sports and lake activities, do so under their sole and entire responsibility. In the case of minors, this responsibility falls to their legal guardians.
8. For legal purposes, any dispute relating to the interpretation or execution of these general terms and conditions shall be subject to the exclusive jurisdiction of the courts of Lausanne, Switzerland.
9. Changes to Terms and Conditions: The information, photos, prices, and other content on the OffAxis Sàrl website may be modified at any time. These terms and conditions, in their version applicable at the time of booking, remain binding.
